General Terms and Conditions

1. Scope of application

The following General Terms and Conditions (GTC) apply to all services provided by the Münchner Kammerspiele in connection with the reservation, sale and delivery of admission tickets (hereinafter referred to as ‘tickets’) and other services and items offered by the Münchner Kammerspiele, provided that they were booked via the Münchner Kammerspiele web shop at www.muenchner-kammerspiele.de (hereinafter referred to as ‘online bookings’).


2. Requirements for online bookings

Admission to online bookings requires a one-time online registration, during which each registered person sets a personal password. The registered person is responsible for ensuring that the password is not disclosed to unauthorised persons and is liable for any misuse resulting from this.

3. Data security

The Münchner Kammerspiele transfers customer data using a secure procedure (SSL Secure Socket Layer with 128-bit encryption) that complies with the standard used by internet banks for data transactions. This ensures the highest possible security standard.

For payment transactions, the necessary personal data is transmitted to the credit institution or the institution responsible for payment processing upon request.

All transmitted data is processed and used by the Münchner Kammerspiele in compliance with the applicable data protection regulations. It is not passed on to third parties.


4. Conclusion of contract

By initiating an online booking, the registered person submits an offer within the meaning of § 145 BGB (German Civil Code). The Münchner Kammerspiele confirms receipt of the contract offer online (order confirmation). The offer is accepted upon receipt of payment or, in the case of cash payment, upon collection of the ordered tickets or goods.

5. Retention of title

The tickets or goods remain the property of the Münchner Kammerspiele until full payment has been received.


6. Ticket sales

6.1. Quantity restrictions

For some events, the number of tickets available for online booking is limited. Further restrictions may apply.


6.2. Prices and shipping costs

The prices published on the internet for the respective event apply. The prices offered are inclusive prices, i.e. any system fees incurred are included in the price. Certain discounts are only visible after logging in and can only be selected if the customer number is provided.

The registered person is responsible for checking whether the conditions for the discounts offered are met. A discount can only be granted if it is specified when purchasing the ticket. No discounts are possible after the purchase process has been completed. The requirements for claiming the discount must be met on the day of the performance. Proof of eligibility must be provided to the admission staff without being asked by presenting photo ID. Otherwise, the difference to the full ticket price must be paid before admission.

6.3. Reservations

Reserved tickets must be paid for at the box office or in the online shop within 7 calendar days and no later than 7 calendar days before the date of the event. Otherwise, the reservation will expire. After payment, the reserved tickets can be sent as digital tickets to the email address provided.


6.4. Payment

Online orders can be paid for directly in the Münchner Kammerspiele web shop by credit card, Mastercard or Visa, or PayPal.

If the payment is not completed due to insufficient funds in the account or other reasons, the order is invalid from the outset. Paid tickets cannot be returned. The provisions on cancellation and return rights for distance contracts do not apply to ticket purchases due to Section 312g (2) No. 9 of the German Civil Code (BGB). This means that there is no two-week cancellation and return right.


5. retention of title

6. Ticket sales

6.2 Prices and shipping costs


The prices published on the Internet for the respective event apply. The prices offered are inclusive prices. Certain discounts are only visible after logging in and can only be selected after entering the customer number.
The customer is responsible for checking whether the conditions for the discounts offered are met. A discount can only be granted if this is communicated by the visitor when purchasing the ticket. Once the purchase process has been completed, no further discounts can be granted on the ticket purchased. The prerequisite for claiming the discount must exist on the day of the performance. The customer must provide the admission service with proof of eligibility by presenting a photo ID without being asked. Otherwise, the difference to the full ticket price must be paid before admission.

6.3 Reservation


Reserved tickets must be paid for at the box office or in the webshop within 7 calendar days and at the latest 7 calendar days before the day of the event. Otherwise the reservation will be cancelled. After payment, the reserved tickets can be sent as a digital ticket to the e-mail address provided.


6.4 Payment


Online orders can be paid for directly in the Münchner Kammerspiele webshop by credit card, Mastercard or Visa, or PayPal.
If payment is not made due to insufficient funds in the account or for other reasons, the order is invalid from the outset
Paid tickets will not be taken back. The regulations on cancellation and the right of return for distance selling contracts are not applicable to ticket purchases due to § 312g para. 2 no. 9 BGB. This means that there is no two-week right of cancellation and return.

6.5 Ticket delivery


The customer is obliged to check the tickets handed out or order confirmations transmitted online for conformity with the order (number, price, date, time and venue) immediately upon receipt. Complaints about incorrect tickets must be made immediately (i.e. within two working days) after receipt of the consignment or order confirmation. The complaint must be made in writing by e-mail to theaterkasse@kammerspiele.de. The date of the transmission protocol of the e-mail is decisive for compliance with the complaint deadline. 6.5.1 Collection at the box office


Reserved tickets can be collected at the box office of the Münchner Kammerspiele (Maximilianstraße 28, 80539 Munich) during opening hours (from Mon. to Sat. 11.00 to 19.00) on presentation of the order number. In the case of discounted tickets, proof of entitlement to the discount must be provided without being asked.
Paid tickets can also be deposited at the box office for a fee of 1.90 EUR. Tickets must be collected no later than 30 minutes before the start of the performance. The box office opens one hour before the start of the performance at the respective venue.

6.5.2 Shipping


Paid tickets can also be sent by post on request. A shipping fee of EUR 5.90 will be charged for this. The dispatch is at the customer’s risk. If the purchased tickets have not arrived within 2 weeks of the order being placed, the customer is obliged to contact the Münchner Kammerspiele box office.
6.5.3 Print @ Home PDF tickets
The Münchner Kammerspiele offers the ‘Digital Ticket’ delivery method. The tickets are sent by e-mail directly after the order process and can be printed out on the customer’s own printer and/or accessed on a digital device. For admission control, the tickets are checked electronically using a scanner and validated after being scanned once. The tickets can be presented both on a digital device and on a printout.

6.5.3. Print @ Home PDF tickets

The Münchner Kammerspiele offers ‘digital ticket’ delivery. Tickets are sent by email immediately after the order process and can be printed out on the customer’s own printer and/or accessed on a digital device. For admission control, the tickets are checked electronically by a scanner and validated after a one-time scan. The tickets can be presented either on a digital device or as a printout.


6.6. Rebooking

Paid tickets can be rebooked on request up to two working days before the performance date at the latest. Rebooking is only possible for another event within the current advance booking period. A fee of EUR 5.00 per ticket will be charged for each rebooking.

Rebookings can only be made in person at the theatre box office, by telephone or by email; they are not possible at the evening box office. No refunds will be given for any difference in price.

If the registered person has already received the tickets, the originals must be returned before the rebooking can be made.

6.7. Expiry policy for tickets, subscriptions and vouchers

No replacement will be provided for expired tickets and gift vouchers. This also applies to subscription performances that were not attended or not returned on time, as well as expired subscription vouchers. The reason why a performance was not attended or a subscription voucher was not redeemed is irrelevant.

Gift vouchers and cancellation vouchers cannot be returned.

7. Cancellation of performances

If a performance is cancelled and less than half of the performance has been played at the time of cancellation, a replacement performance will be offered. If this is not possible for scheduling or other reasons, the ticket price will be refunded or a voucher will be issued. Any further claims are excluded; in particular, expenses incurred by the registered person, such as travel or accommodation costs, cannot be reimbursed.


8. Performance changes

If the Münchner Kammerspiele offers a different event on the date of an event instead of the one originally planned, the contract may be terminated and a refund of ticket prices already paid may be requested. However, termination must take place before the start of the replacement performance by returning the tickets to the theatre box office/evening box office.

Cast changes and other short-term changes to the performance schedule or cases of force majeure (traffic disruptions, illness, epidemics, strikes, weather conditions, etc.) do not entitle the purchaser to return tickets.

9. Sale of goods

The provisions of this Section 9 do not apply to ticket sales, but only to the sale of goods.
(The provisions on the right of withdrawal and return in distance contracts do not apply to ticket sales pursuant to Section 312 g (2) No. 9 BGB.)


9.1. Delivery and shipping costs

The delivery of ordered goods shall be made to the delivery address of the registered person specified in the order process. The shipping costs specified in the order process shall apply.

9.2. Cancellation policy
RIGHT OF CANCELLATION

You have the right to cancel the contract for the purchase of goods within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a person designated by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. As soon as we receive your withdrawal notice, you will receive confirmation immediately (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the inexpensive standard delivery offered by us), without delay and at the latest within 14 days of the day on which we receive notification of your withdrawal from the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the voucher(s) or goods back or until you have provided proof that you have returned the voucher(s) or goods, whichever is earlier. You must return or hand over the voucher(s) or goods to us immediately and in any case within 14 days of the day on which you notify us of the cancellation of this contract. The deadline is met if you send the voucher(s) or goods before the 14-day period expires. You shall only bear the direct costs of returning the voucher(s) or goods. You shall only be liable for any loss in value of the voucher(s) or goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.

End of cancellation policy


9.3. Exclusion of cancellation

The right of cancellation is excluded for contracts for the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the registered person.

10. Place of performance

The place of performance for delivery, service and payment is Munich

11. Applicable law and place of jurisdiction

German law applies exclusively. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The provisions on revocation and the right of return for distance contracts do not apply to ticket sales due to Section 312 g (2) No. 9 of the German Civil Code (BGB).

The place of jurisdiction is Munich.


12. Severability clause

Should individual provisions of these General Terms and Conditions be invalid, the remaining provisions shall remain valid.
